Welcome to Payfonte! These terms of service ('Terms') apply to your use of our payment orchestration platform, Payfonte. By using Payfonte, you agree to these Terms. If you do not agree to these Terms, please do not use our services.

Please read there terms of service carefully before signing up as a merchant. If you do not agree to any or all of these Terms of Service, PLEASE DO NOT USE OUR SERVICES.!

Use of Payfonte
  • You may use Payfonte only for lawful purposes and in accordance with these Terms. You agree not to use Payfonte:
    • 1. In any way that violates any applicable federal, state, local, or international law or regulation;
    • 2. In any way that violates any applicable federal, state, local, or international law or regulation;
    • 3. To transmit, or procure the sending of, any advertising or promotional material, including any 'junk mail', 'chain letter,' 'spam,'' or any other similar solicitation;
    • 4. To impersonate or attempt to impersonate Payfonte, a Payfonte employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing);
    • 5. To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Payfonte, or which, as determined by us, may harm Payfonte or users of Payfonte or expose them to liability.
  • We reserve the right to terminate or suspend your access to Payfonte at any time, with or without cause, and without liability to you.
Your Account
  • In order to use certain features of Payfonte, you may need to create an account with us. You agree to provide accurate and complete information when you create your account, and to keep your account information up-to-date. You are solely responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Payment Processing
  • Payfonte allows you to process payments using various payment methods. You are solely responsible for verifying the accuracy and completeness of any payment information you provide, including the amount of the payment and the payment method. We are not responsible for any errors or omissions in the payment information you provide. When you use Payfonte to process a payment, you authorize us to charge your payment method for the amount of the payment, plus any applicable fees. You acknowledge and agree that we may use a third-party payment processor to process your payment.
Fees/Charges
  • We may charge fees for the use of Payfonte, including transaction fees and other fees related to the processing of payments. You agree to pay all fees associated with your use of Payfonte. We reserve the right to modify our fees at any time, with or without notice, but we will provide you with notice of any fee changes before they take effect.
Intellectual Property
  • Payfonte and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Payfonte or its licensors and are protected by Nigeria and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
  • You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use Payfonte for your personal use only. You may not use, copy, reproduce, distribute, modify, or create derivative works of any portion of Payfonte, except as expressly authorized by us.
Disclaimer of Warranties
  • Payfonte is provided on an 'as is' and 'as available basis, without warranties of any kind, either express or implied. We do not warrant that Payfonte will be uninterrupted or error-free, nor do we make any warranty as to the accuracy, completeness, or reliability of any information obtained through Payfonte.
Limitation of Liability
  • In no event shall Payfonte be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of Payfonte, including but not limited to damages for loss of profits, goodwill, use, or data.
Indemnification
  • You agree to indemnify and hold harmless Payfonte and its affiliates, officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of Payfonte.
Changes to These Terms
  • We may update these Terms from time to time to reflect changes in our services or to comply with legal requirements. We will notify you of any material changes to these Terms by email or by posting a notice on our website.
Class Action Waiver
  • You and Payfonte agree that any dispute resolution proceedings, whether in arbitration or court, will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, you and Payfonte each waive any right to a jury trial. You and Payfonte also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.
Force Majeure
  • Payfonte shall not be liable for any failure or delay in performance of its obligations under these Terms of Service if the failure or delay is due to any cause beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, earthquakes, labor disputes, or shortages of transportation, facilities, fuel, energy, labor or materials (each a 'Force Majeure Event').
  • If a Force Majeure Event continues for a period of thirty (30) days or more, either party may terminate these Terms of Service without liability to the other party.
  • Payfonte shall not be responsible for any delay or failure in performance resulting from acts beyond its control, including, without limitation, acts of God, acts or regulations of any governmental, national emergency, fire, civil disobedience, terrorism, war, strikes, communication, power failures or equipment or software malfunction.

  • We may update these Terms from time to time to reflect changes in our services or to comply with legal requirements. We will notify you of any material changes to these Terms by email or by posting a notice on our website.
